TERMS OF SERVICE

1. DEFINITIONS

• "Platform" or "Service": The www.ecomstudio.com.tr website and the AI-powered image animation and video generation services offered here.
• "User" or "You": The person or organization that uses the Platform, creates an account, and accesses the services.
• "Balance": Digital units that can be purchased and used for video generation on the Platform.
• "Content": Images, pictures, photos, and all types of digital materials uploaded to the platform by users.
• "Generated Video": Video files created by the Platform using AI technology from the content uploaded by the user.

2. SERVICE DESCRIPTION

Ecomstudio is a SaaS (Software as a Service) platform that animates static images uploaded by users using artificial intelligence technology and converts them into video format. Through the Platform, the following services are provided:

• Uploading images
• AI-powered video generation
• Downloading generated videos
• Balance purchase and management

3. USER ACCOUNT AND LOGIN

3.1. You must create a valid user account to use the Platform.

3.2. You must be at least 18 years old to create an account.

3.3. All information you provide during registration must be accurate, current, and complete.

3.4. Account security is entirely your responsibility. You are obligated to keep your password confidential and are responsible for all activities that occur on your account.

3.5. If you detect any unauthorized use of your account, you must contact us immediately.

3.6. A person or organization may only create one account. Creating multiple accounts is prohibited.

4. BALANCE SYSTEM AND PAYMENT TERMS

4.1. You must purchase balance to generate videos on the Platform.

4.2. Balance can be purchased via credit card or other payment methods provided on the Platform.

4.3. Balance Activation: Balance is immediately added to your account upon successful payment and becomes available for use instantly.

4.4. Balance Expiration: Purchased balance has a validity period. The expiration date for your balance is displayed in your account dashboard and on the Platform at the time of purchase. Unused balance will automatically expire and be removed from your account at the end of its validity period.

4.5. Expired Balance: Balance that has passed its expiration date is non-refundable and cannot be reinstated under any circumstances. Please monitor your balance expiration dates regularly in your account settings.

4.6. Payment transactions are carried out through secure payment systems. Ecomstudio does not store your credit card information.

4.7. All prices are displayed in USD and may include applicable taxes.

4.8. Prices may be changed without prior notice. However, the price you paid for balance you have already purchased will not change.

5. REFUND AND CANCELLATION POLICY

5.1. Right of Withdrawal for Digital Content

IMPORTANT: In accordance with Article 15/1(ğ) of the Turkish Distance Contracts Regulation, the right of withdrawal does not apply to digital content delivered instantly in non-physical form where the consumer has expressly approved the commencement of performance before the expiry of the withdrawal period.

By purchasing balance on our platform, you acknowledge and expressly agree that:

• Balance is digital content delivered instantly to your account
• You waive your 14-day right of withdrawal
• The digital content (balance) will be made available immediately upon payment confirmation
• Once balance is added to your account, the purchase is final and non-refundable

5.2. General Refund Policy

As this is a digital service, purchased balance is generally non-refundable whether used or unused. However, the following exceptions apply:

5.3. Balance Reservation System

When you submit a video generation request, the required balance is immediately reserved (held) in your account. Reserved balance cannot be used for other requests until the process is completed.

5.4. Automatic Refund for Technical Failures

If a video generation request fails due to a technical issue or system error, the reserved balance will be automatically refunded to your account within 30 minutes. This refund process is handled automatically by our system.

5.5. Video Generation Failures

5.5.1. If a video cannot be generated successfully due to platform-related technical issues, the balance reserved for that request will be returned to your available balance.

5.5.2. Balance will not be refunded if the failure is caused by user error, such as uploading incompatible file formats or violating content policies.

5.6. Payment Errors and Billing Issues

5.6.1. In case of incorrect billing or duplicate charges, you must contact us within 14 days with evidence documenting the situation.

5.6.2. Verified billing errors will be refunded to your original payment method or added to your account balance at our discretion.

5.7. Expired Balance

Balance that has expired is non-refundable under any circumstances. Please monitor your balance expiration dates in your account dashboard.

5.8. Exception for Unused Balance

If you have not used any balance and believe there was an error in your purchase, please contact us at hello@ecomstudio.com.tr within 24 hours of purchase. We will review your case on an individual basis, though refunds are not guaranteed.

5.9. Consumer Rights

Your consumer rights under Turkish Law No. 6502 (Consumer Protection Law) are reserved. This policy complies with Turkish Distance Sales regulations. You may file complaints with Consumer Arbitration Committees or Consumer Courts in Istanbul within applicable monetary limits.

5.10. Refund Processing Time

Approved refunds will be processed within 14 business days. The time it takes for the refund to appear in your account may vary depending on your payment provider.

6. USER CONTENT AND RESPONSIBILITIES

6.1. Content Ownership and Rights

For all content you upload to the Platform, you guarantee that:

• You are the full rights holder
• You have all necessary permissions
• The copyrights belong to you or you have the right to use them
• You have obtained model releases for model photography
• You have obtained the necessary permissions from individuals in the images
• You are authorized to use brands and logos

6.2. Prohibited Content and Uses

Uploading the following types of content to the platform or using the platform for these purposes is strictly prohibited:

a) Illegal Uses:

• Committing or inciting crime
• Blackmail, threats, or bullying
• Fraud or forgery
• Terrorism, violence, or hate speech
• Promoting drug or illegal substance use

b) Sexual and Exploitative Content:

• Child abuse or any content depicting children as sexual objects
• Pornographic or obscene content
• Sexual harassment or disturbing content
• Non-consensual nude or intimate images

c) Violence and Hate Content:

• Extreme violence, blood, death, or injury images
• Hate speech or discrimination
• Human or animal rights violations

d) Misleading and Harmful Content:

• Deepfake or misleading content generation
• Creating fake identities
• Disinformation or misinformation
• Unauthorized use of public figures, celebrities, or real persons
• Political manipulation or election interference

e) Intellectual Property Violations:

• Content that violates copyright
• Unauthorized use of trademarks or logos belonging to others
• Patent or trade secret violations

f) Other Prohibited Uses:

• Spam or unsolicited promotional content
• Attempts to compromise platform security
• Using bots or automated systems to use the platform
• Collecting or stealing other users' data

6.3. Content Responsibility

• You are solely responsible for all content you upload to the Platform.
• You guarantee that the content you upload is legal, ethical, and compliant with these Terms of Service.
• You are responsible for ensuring that your content does not infringe third-party rights.
• All legal and criminal liability arising from uploading illegal or inappropriate content is yours.

6.4. Content Monitoring and Removal Rights

• Ecomstudio has the right, but not the obligation, to monitor content uploaded to the platform.
• We reserve the right to remove inappropriate, illegal, or content that violates these terms without prior notice.
• If illegal content is detected, we have the right to report it to legal authorities.

7. USE OF GENERATED VIDEOS

7.1. You own the rights to videos generated by the Platform, but these rights depend on the legality of the original content you uploaded.

7.2. You may use generated videos for commercial or personal purposes.

7.3. However, when using generated videos, you are obligated to comply with the prohibited use terms stated above.

7.4. It is your responsibility to comply with local laws regarding AI-generated content.

7.5. Ecomstudio is not responsible for how generated videos are used.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. The Platform, website design, logo, brand, software, code, AI algorithms, interface, and all other elements are the property of Ecomstudio or its licensors.

8.2. By using the Platform, you do not acquire any rights to these elements.

8.3. Copying, reproducing, distributing, reverse engineering, or creating derivative works from Platform content is prohibited.

8.4. The "Ecomstudio" brand and logo are registered trademarks and may not be used without permission.

9. SERVICE USAGE TERMS

9.1. You agree to use the Platform only for lawful purposes and in accordance with these Terms of Service.

9.2. Prohibited behaviors on the Platform:

• Attempting to disrupt the Platform's operation
• Attempting to bypass security measures
• Uploading viruses, malware, or malicious code
• Gaining unauthorized access to other users' accounts
• Collecting Platform data with automated tools (scraping)
• Abusing or overloading the service

9.3. Failure to comply with these rules may result in suspension or permanent closure of your account.

10. ACCOUNT SUSPENSION AND CLOSURE

10.1. Ecomstudio reserves the right to suspend or permanently close your account in the following situations:

• Violation of these Terms of Service
• Uploading illegal content
• Providing false or misleading information
• Payment issues or fraudulent transactions
• Compromising platform security
• Attempts to harm other users

10.2. In case of account closure, unused balance is non-refundable.

10.3. Upon request from legal authorities, user information and content may be shared.

11. SERVICE AVAILABILITY AND LIMITATIONS

11.1. The Platform aims to provide 24/7 service but does not guarantee it.

11.2. Service interruptions may occur due to maintenance, updates, technical failures, or unforeseen reasons.

11.3. Ecomstudio reserves the right to improve, modify, or discontinue the service.

11.4. Planned maintenance work will be announced in advance whenever possible.

11.5. Ecomstudio is not responsible for data loss, business loss, or other damages that may occur due to service interruptions.

12. DATA SECURITY AND PRIVACY

12.1. Your personal data is processed and protected under our Privacy Policy and KVKK (Personal Data Protection Law).

12.2. The Platform takes reasonable security measures to protect your data.

12.3. However, you acknowledge that data transmission over the internet is not 100% secure.

12.4. It is recommended that you back up the content you upload.

13. THIRD-PARTY LINKS AND SERVICES

13.1. The Platform may contain links to third-party websites or services.

13.2. Ecomstudio is not responsible for these third-party sites.

13.3. Use of third-party services is subject to the respective service's own terms.

14. LIMITATION OF LIABILITY

14.1. The Platform is provided "as is" and "as available."

14.2. Ecomstudio makes no warranties regarding:

• The service will be uninterrupted or error-free
• The quality or accuracy of generated videos
• The service will meet your specific needs

14.3. Ecomstudio cannot be held liable for:

• User content being illegal or inappropriate
• Issues arising from users' use of their content
• Third-party rights violations
• Data loss or security breaches
• Indirect, incidental, or consequential damages
• Loss of business, revenue, or reputation

14.4. To the maximum extent permitted by law, Ecomstudio's total liability is limited to the fees you paid in the last 12 months.

15. INDEMNIFICATION

15.1. You agree to indemnify Ecomstudio against all damages, expenses, lawsuits, and claims arising from:

• Third-party claims
• Copyright or intellectual property violations
• Violation of these Terms of Service
• Your unlawful conduct

16. MODIFICATIONS

16.1. Ecomstudio reserves the right to modify these Terms of Service at any time.

16.2. Significant changes will be announced via email or platform notification.

16.3. Your continued use of the platform after changes are published means you accept the new terms.

16.4. If you do not accept the changes, you must stop using the platform.

17. TERMINATION

17.1. You may close your account at any time.

17.2. Ecomstudio may terminate your account with or without notice in case of violation of these Terms of Service.

17.3. In case of termination, no refund will be made for unused balance.

17.4. Even after termination, relevant provisions of these Terms of Service (limitation of liability, indemnification, dispute resolution, etc.) will continue to remain in effect.

18. GOVERNING LAW AND DISPUTE RESOLUTION

18.1. These Terms of Service are governed by the laws of the Republic of Turkey.

18.2. All disputes arising from or related to these terms are subject to the exclusive jurisdiction of Istanbul Courts and Enforcement Offices.

18.3. Users who are consumers may also apply to Consumer Arbitration Committees within the framework of their legal consumer rights.

19. GENERAL PROVISIONS

19.1. These Terms of Service constitute the entire agreement between the parties.

19.2. Ecomstudio's failure to exercise any right does not constitute a waiver of that right.

19.3. The invalidity of any provision of these terms does not affect the validity of other provisions.

19.4. Ecomstudio may transfer its rights and obligations without notice.

19.5. Users may not transfer their rights arising from this agreement without Ecomstudio's written consent.
